The petitioner seeks bail in a case under Section 399, 402, 414 of the Indian Penal Code and under section 25(1-b) a/26/35 of the Arms Act.

The police apprehended the petitioner and other accused persons on the allegation that the petitioners were preparing for committing dacoity. From the possession of the petitioner one country made pistol and a live cartridges were recovered. The petitioner is in jail since 27.11.2014. The petitioner had no criminal antecedent but after being apprehended in the present case the police implicated the petitioner in three other cases. Similarly situated accused Krishna @ Vikky has already been enlarged on bail.

No.35165 of 2015 (2) dt.21-08-2015 2/2 Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, (West), Muzaffarpur in Brahampura P.S. Case No. 263 of 2014.
