After hearing the learned counsel for the petitioners, it appears that the writ application has been filed in a hurry as till date, no order of punishment has been passed against the employees of the Nagar Parishad.

At this stage, the learned counsel for the petitioners

Patna High Court CWJC No.4650 of 2018(2) dt.28-03-2023 2/2 seeks permission to withdraw the present writ application with a liberty to the petitioners to move afresh, in the event, if any punishment is inflicted or an adverse decision is taken against the petitioners who are employees of the municipality, as it has been submitted by the learned counsel for the petitioners that the petitioners have been proceeded against based on a proceeding initiated against them in breach of Section 49 of the Municipal Act.

Permission is accorded.

Accordingly, instant writ application is dismissed as withdrawn with the liberty aforesaid.
