Heard the learned counsel for the petitioners, the informant and the State.

The petitioners seek bail in anticipation of their arrest in connection with Sikandara P. S. Case No. 263 of 2018 dated 08.11.2018 instituted for the offences under Sections 341, 323, 307, 506, 504/34 of the Indian Penal Code.

The petitioners are alleged to have assaulted the

Patna High Court Cr.Misc. No.6881 of 2019(2) dt.06-02-2019 2/3 physically disabled brother of the informant while he was coming back from temple on the night of the Deepawali festival.

Learned counsel for the petitioners has submitted that an absolutely false case has been lodged against the petitioners who do not have any criminal antecedents. The so called injured, i.e., the brother of the informant, has been made accused in a case vide Sikandara P. S. Case No. 264 of 2018, lodged by the mother of petitioner no. 1. The injury suffered by the brother of the informant is stated to be simple in nature.

Taking all these facts into account, the petitioners, above-named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sri M. K. Pandey, J.M. 1st Class, Jamui in connection with Sikandara P. S. Case No. 263 of 2018,
