At the outset, it has been informed that the charges have already been framed in the matter and as such so far as this application for quashing of the cognizance order dated 16.01.2019 passed by the learned Judicial Magistrate-1st Class, Kaimur in Complaint Case No. 1557 of 2018 is concerned, it has now become infructuous.

In view of the aforesaid facts and circumstances , learned counsel for the petitioner submits that he may be permitted to withdraw this application so that he can pursue all his remedy as also law points before the learned Court below at an appropriate stage.
