The petitioner apprehends his arrest in Sasaram (M) P.S. Case No. 403 of 2022, registered for the offences punishable under Sections 25(1-b)a/26 of the Arms Act. As per the prosecution case, two country made rifles of 315 bore were recovered from the house of petitioner. It is submitted that house in question does not belong to this petitioner and this petitioner resides in Maharashtra and as such petitioner cannot be held responsible for recovery of arms.

Counsel for State opposed the prayer for bail and submitted that from perusal of FIR it is apparent that arms were recovered from the house of petitioner and petitioner has got one criminal antecedent.
