The petitioner seeks bail in a case registered under Sections 392/411 of the Indian Penal Code.

The prosecution case in brief is that while the informant along with his friend was returning home from fair by his motorcycle, in the way, four miscreants on the point of pistol and knife, snatched his motorcycle and fled away. It has been submitted on behalf of the petitioner that the petitioner has not no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 02-10-2018. Charge sheet has already been submitted. The petitioner is not named in the FIR.

Patna High Court CR. MISC. No.6147 of 2019(3) dt.18-04-2019 2/2 No test identification parade of the petitioner was conducted to ascertain the participation of the petitioner in this case. Except for recovery of a stolen motorcycle from possession of the petitioner, there is no substantive evidence to suggest the implication of the petitioner in the alleged offence. On behalf of the State, it is submitted that the petitioner is not named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Gopalganj in connection with Manjhagarh P.S. Case No. 302 of 2018.
