The petitioner seeks regular bail in connection with Sessions Trial No. 51 of 2021, arising out of Purnahiya P.S. Case No. 150 of 2020 lodged under Sections 307, 302, 120(B) and 34 of the Indian Penal Code, 1860 and Section 27 of the Arms Act.
As per the allegation made in the F.I.R., when campaign of election rally was going on village- Hathisar, two miscreants started indiscriminate firing, in result the informant's younger brother was died and local villager namely, Santosh Kumar Mahto died. It appears as per the F.I.R., itself that two persons were apprehended namely, Gauri Shankar Maharaj and Niraj Pathak.

No.6653 of 2022(2) dt.13-06-2022 2/2 Learned counsel for the petitioner submits that charge sheet has already been filed in this case and petitioner is in custody since 23.11.2020. He further submits that two other accused namely, Ram Pravesh Rai and Rajeev Thakur with similar allegation as like that of the present petitioner, have been granted bail by this Court vide order dt. 18.11.2021 and 02.12.2021 passed in Cr. Misc. No. 25728 of 2021 and 34451 of 2021 respectively.
Learned A.P.P. has opposed the prayer for bail. Considering the fact that there is general and omnibus allegation and two persons upon whom the allegation of firing, have already been arrested from the spot. Charge sheet has already been submitted, charges have already been framed and petitioner is in custody since 23.11.2020, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-III, Sheohar in connection with Sessions Trial No. 51 of 2021, arising out of Purnahiya P.S. Case No. 150 of 2020 (Dr. Anshuman, J) ravishankar/- U T
