In this case, the petitioners are seeking anticipatory bail in connection with Roh P.S. Case No.150 of 2019, registered for the offence punishable under Sections 341, 323, 504, 506, 307/34 of the Indian Penal Code.

As per FIR, when the informant was standing near the door of his house, all the petitioners reached there with two motorcycles and after parking the said motorcycles at his door, they were going away, upon which, the informant asked them not to park the motorcycles, then the accused persons started abusing and on being protested, all started assaulting due to which he sustained head injury, however, counsel for the

No.5203 of 2020(2) dt.28-02-2020 2/2 petitioners submits that during investigation, the police has recorded the restatement of the informant wherein he has disclosed that co-accused Sudhir Yadav has started abusing the informant and assaulted his mother over her head and the said disclosure made by the informant was also supported by independent witnesses, as such, the informant has changed his initial version in the restatement.

Looking to the entire facts and circumstances of the case, let the petitioners, above-named, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate-1st Class, Nawada in connection with Roh P.S. Case no.150 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
