Heard the learned counsel for the petitioner as well as the learned counsel for the informant.

The petitioner apprehends his arrest in connection with Mahila P.S. Case No. 40 of 2018 registered for offence punishable under sections 341, 323, 498(A), 504/34 of the Indian Penal Code.

The learned counsel for the petitioner has submitted that the petitioner is ready to provide maintenance to the informant at the rate of Rs. 4,000/- per month. Considering the above-mentioned facts and

No.16918 of 2021(5) dt.04-07-2022 2/2 circumstances that the petitioner is ready to provide maintenance to the informant at the rate of Rs. 4,000/- per month, let him, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Madhubani in connection with Mahila P.S. Case No. 40 of 2018, subject to condition as laid down under section 438(2) Cr. P.C. The amount of maintenance must be deposited till 10th day of each month in the bank account of the informant. The learned court below would be at liberty to cancel the bail bond, in case the petitioner retracts from his words.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
