The petitioner seeks bail in a case registered for the offences punishable under sections 302/34 of the Indian Penal Code and section 27 of the Arms Act.
The informant named four persons, namely, Akhilesh Chauhan, Chandramani, Jitendra Kumar, petitioner, and Anju Devi and alleged that they all having armed with fire arm scale over the roof of the informant. Akhilesh and Chandramani made firing causing death of Azad Kumar, nephew of the informant. There is no specific allegation of firing against the petitioner.
Learned counsel for the informant, however,
Patna High Court Cr.Misc. No.37251 of 2015 (2) dt.25-08-2015 vehemently opposed the prayer for bail of the petitioner. Considering the facts aforesaid and that there is no allegation of firing against the petitioner, the petitioner above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sumit Ranjan, Judicial Magistrate, 1st Class, Hilsa, Nalanda in connection with Islampur P.S. Case No. 188 of 2014.
