The petitioner apprehends his arrest in connection with Purnia Sadar P.S. Case No. 281 of 2019 registered under Section 379 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case merely on suspicion. Further submission is that the petitioner is the driver of the alleged vehicle but the alleged vehicle was stolen. The owner of the vehicle had filed information before the S.P., Purnia regarding theft of the alleged vehicle and in this regard the brother of the owner of the vehicle also filed an Informatory Petition before the Court of Chief Judicial Magistrate, Purnia vide Annexure

Patna High Court CR. MISC. No.16824 of 2021(12) dt.28-04-2022 2/2 Nos. 4 and 5 of the second supplementary affidavit. Petitioner has no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Chief Judicial Magistrate, Purnia in connection with Purnia Sadar P.S. Case No. 281 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
