JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-04-2019 This is an application for grant of anticipatory bail in connection with Alauli P.S. Case No. 280 of 2018, G.R. No.2338 of 2018 disclosing offences under Sections 341, 307, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation as per written report is that while the informant was returning with the goat of Qurbani, then the coaccused Md. Rahman started abusing him and fired upon him, which hit on Md. Nikail and it is further alleged that the petitioners and other accused persons also made firing. Submission of learned counsel for the petitioners is that there is no specific allegation against these petitioners,

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Alauli P.S. Case No. 280 of 2018, G.R. No.2338 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
