The petitioner seeks regular bail in connection with Rohtas P.S. Case No. 46 of 2015 for the offences punishable under Sections 302/201/34 of the Indian Penal Code. The allegation is regarding the parents of the informant having been missing since 04.03.2015 and after one month, decomposed body was recovered. The informant had expressed suspicion against the petitioner and other co-accused persons while disclosing the fact that the wife of Bir Bahadur Singh had illicit relation with one Ram Dular Singh Kharwar and it was co-accused Bir Bahadur Singh, who had invited the petitioner and other extremists to kill his parents, so that Bir Bahadur Singh could grab the lands of deceased persons. No.7042 of 2019(2) dt.08-02-2019 2/2 accused persons i.e. Bir Bahadur Singh and Ram Dular Kharwar have already been granted bail, one of such orders being order dated 01.09.2016 passed by a co-ordinate Bench of this Court in Cr. Misc. No. 36939 of 2016. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 02.07.2018.

Having regard to the facts and circumstances of the case as also considering the fact that similarly situated coaccused persons have already been granted bail, I deem it fit and proper to direct for release of the petitioner, above named, on regular bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Dehri in connection with Rohtas P.S. Case No. 46 of 2015.
