The petitioners seek bail in Warisaliganj P.S. Case No.29 of 2018 registered for the offence punishable under Sections 379 of the Indian Penal Code.

Allegation against the petitioners is of committing theft of motorcycle.

Submission of learned counsel for the petitioner is that the petitioner has been falsely implicated in this case on the basis of confessional statement of co-accused Prince Kumar and Deepak Kumar, both co-villagers and they are in custody since 18.11.2019. Further submission is that nothing incriminating article has been recovered from the conscious possession of the

Patna High Court CR. MISC. No.5836 of 2020(2) dt.03-02-2020 2/2 petitioners nor they have been put on T.I.Parade. The petitioners also accused in three other cases.

Heard learned Addl. Public Prosecutor.

Be that as it may, considering facts and circumstances, as stated above, let the petitioners be enlarged on bail on furnishing bail bond of Rs.25,000/-(twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned 1st Assistant Chief Judicial Magistrate, Nawada in connection with Warisaliganj P.S. Case No.29 of 2018 with condition that they have to appear before the local police station of their area for a period of six months, so that the police may watch the activities of the petitioners, otherwise the bail bond of the petitioners shall be cancelled.

Let a copy of the order be communicated to the Superintendent of Police, Nawada for the needful. With the above direction, this application is allowed. (Vinod Kumar Sinha, J) nawalkrs/- U T
