The petitioner, who is in custody since 14.10.2019 and does not have criminal antecedent, seeks bail in connection with Gogri P.S. Case No. 341/2019 dated 13.10.2019 instituted for the offence under Sections 406, 420 and 379 of the Indian Penal Code.

As the allegation goes, the petitioner is said to have duped the informant while he was taking out money from the ATM Center. It is alleged that in order to help the informant in taking out money, the petitioner took the ATM card of the informant and exchanged it with an old ATM card. In order to avoid such payment, the present story has been cooked up by the informant. Regarding being had to the nature of offence, the period of custody of the petitioner and he being a person of clean antecedent, he is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of Learned Chief Judicial Magistrate, Khagaria in connection with Gogri P.S. Case No. 341/2019 dated 13.10.2019.
