JUSTICE SUDHIR SINGH ORAL ORDER 23-11-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302 and 120B of the Indian Penal Code and 27 of the Arms Act.

Allegation against the petitioner is that he tried to make illicit relationship with the second wife of the deceased while he was in jail in another case. Thereafter, an altercation took place between the petitioner and the deceased and petitioner threatened the deceased.

It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He is in custody since 30.5.2015. Chargesheet has been submitted in the present case. There is no allegation of tampering of evidence against the petitioner. There is no eye witness to the alleged occurrence. Merely on suspicion petitioner has been named in the present case. There is no direct or indirect evidence against the petitioner to suggest his implication in the present case.

No.37508 of 2015 (4) dt.23-11-2015 2 / 2 On behalf of the State, it is submitted that petitioner is named in the F.I.R. and from perusal of the case diary it would appear that there is no eye witness to the alleged occurrence. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Teghra P.S. Case no. 233 of 2014.
