====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-11-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under Sections 394 of the Indian Penal Code. As per the prosecution case, on 23.06.2020, while the informant was coming from Shiekhpura on his truck, four miscreants came and on the point of pistol snatched Rs. 2500/- and mobile phone of the informant. It is further alleged that on protest by the Khalasi, one of the miscreants fired upon him which hit in the chest. One of the criminals was caught on the spot and later handed over to the police.

It is submitted on behalf of the petitioner that petitioner is not named in the F.I.R. It is further submitted that name of the petitioner surfaced in the confessional statement of co-accused Rishu Kumar who was arrested on the spot. No

Test Identification Parade has not been carried out till date. Petitioner has got no criminal antecedent and he is in custody since 22.08.2020. Considering the facts and circumstances of the case and the period of custody, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge XI, Bhagalpur, in connection with Sabour P.S.
