The petitioner is languishing in custody since 26.06.2014 in a case registered for the offences punishable under Sections 364/34 of the Indian Penal Code.

It is alleged that the informant's husband was taken by this petitioner and one Gupta Paswan to the brick kiln and thereafter husband of the informant did not return. It is submitted by learned counsel for the petitioner that the victim was a veteran criminal and several cases were pending against him. The accusation has been levelled since the petitioner was on inimical terms with the informant's family. A statement has been made in para 3 of the petition that the

Patna High Court Cr.Misc. No.36764 of 2014 (03) dt.16-01-2015 2/2 petitioner has no criminal antecedent and similarly situated accused Gupta Paswan has been granted bail vide Cr. Misc. No. 2533 of 2011.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Ad hoc Additional Sessions Judge 1st, Gaya in connection with Sessions Trial No. 58 of 2012 arising out of Belaganj P.S.
