JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Rohtas P.S. Case No. 27 of 2014, registered for the offences punishable under Section 379 of the Indian Penal Code and Section 135 of Electricity Rules, 2003. Allegation against the petitioner is committing theft of electric energy, causing loss to the tune of Rs.3,06,158/- to the South Bihar Power Distribution Company Ltd..

Submission of learned counsel for the petitioner is that though his mill was not in running condition but he is ready to pay the amount if some reasonable time is granted to him and the payment may be subject to the result of the case. Heard learned APP and learned counsel for the South

Having heard both sides and in view of the above facts and circumstances, the petitioner is directed to surrender in the court below on 15.5.2019 with a Bank Draft for Rs.36,000/- payable in favour of SBPDCL and on such deposit he will be released on provisional bail for a period of nine months by the court below, during that period the petitioner will pay the rest of the amount in nine equal instalments through Bank Draft of Rs.30,000/- each payable in the name of SBPDCL to be deposited on or before 15th of each month, failure to pay any of the instalments, bail bond of the petitioner shall be cancelled. However, once the total amount is deposited, his bail bond shall be confirmed by the court below itself and that payment will be subject to the result of the case.

With the above observation, this application is disposed of.
