JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-02-2020 Petitioners seek bail in connection with Warisaliganj P.S. Case No. 07 of 2018, registered for the offence punishable under Section 379 of the Indian Penal Code.
Prosecution case is of theft of motorcycle and petitioners are not named in the FIR and they have been made accused on the basis of confessional statement of co-accused and apart from that they are accused in two other cases. Submission of learned counsel for the petitioners is that they have been made accused only on suspicion and they are in custody for more than two months.
Heard learned APP also.
In view of above facts and circumstances, let
Patna High Court CR. MISC. No.6154 of 2020(2) dt.04-02-2020 2/2 petitioners be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Nawada, Warisaliganj P.S. Case No. 07 of 2018, subject to the condition that he has to appear before police station of his local area in second week of every month for a period of six months, so that the police may watch their activities.
Let a copy of this order be sent to the Superintendent of Police, Nawada for needful.
