The petitioner is languishing in custody for the offences punishable under Sections 406, 420, 467, 471 of the I.P.C.
Petitioner is in custody since last more than one year. Petitioner has got no criminal antecedent.
Submission is that only allegation is that the petitioner was selling Sim cards without proper verification of identity of the purchaser. However, no such evidence has come during investigation that any such Sim card was sold by the petitioner. Considering the submission aforesaid and completion of investigation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand)
Patna High Court CR. MISC. No.17054 of 2021(3) dt.04-10-2021 2/2 with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sarmera P.S. Case No. 268 of 2020, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
