JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-04-2019 This application, for grant of anticipatory bail, arises out of Sasaram (M) P.S. Case No. 231/2018, disclosing offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Allegation is of recovery of 1468 and odd litres of liquor from the crusher mill one co-accused Arun Singh and it is alleged that petitioner and other accused persons are running the business.
Submission of learned counsel for the petitioner is that nothing has been reovered either from the possession of the petitioner or from his house and he has falsely been implicated in this case at the instance of the police and further he has no criminal antecedent and co-accused having similar allegation has been granted the privilege of anticipatory bail by a
Patna High Court CR. MISC. No.6115 of 2019(4) dt.17-04-2019 2/2 coordinate Bench of this Court vide order dated 05.02.2019 passed in Cr. Misc. No. 6199 of 2019.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned 02nd Additional District & Sessions Judge-cum-Special Judge, Excise, Rohtas at Sasaram, in connection with Sasaram (M) P.S.
