The petitioner being the husband of the victim is languishing in custody since 01.10.2013 in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.

The accusation is of killing the grand daughter of the informant within few months of the marriage for non-fulfillment of the dowry demand.

It is submitted by learned counsel for the petitioner that the informant during trial has not supported the accusation nor does the other two witnesses.

Considering the death being taken place

Patna High Court Cr.Misc. No.36652 of 2014 (03) dt.13-01-2015 2/2 within few months of the marriage, this Court is not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner is rejected in connection with Sessions Trial No. 75 of 2014 arising out of Nawtan P.S. Case No. 91 of 2013 pending in the court of learned Ad hoc Additional Sessions Judge-III, Siwan. It is expected from the learned trial court to conclude the trial expeditiously preferably within a period of six months.
