Petitioners apprehend their arrest in connection with Baisi P.S. Case No. 19/2014 registered for the offences punishable under Sections 304 (B)/34 of the Indian Penal Code. Allegedly, the daughter of the informant was tortured and ultimately she was killed by strangulating by her husband and inlaws including the petitioners. Submission is of false implication, there is no eye witness to the occurrence but only on suspicion, the petitioners have been named. There is no specific allegation. The petitioners have no concern with the affairs of the deceased and her husband,
Patna High Court Cr.Misc. No.36619 of 2014 (3) dt.09-04-2015 2/2 and as such, the petitioners deserve sympathetic consideration to which the learned A.P.P. opposes by submitting that witnesses during investigation have supported the allegation. Considering the submissions at the bar and going through the case diary and record and noticing that there is no specific allegation against the petitioners rather the specific allegation is against the husband of the deceased, and as such, the petitioners above named, in case of their surrender or arrest within two months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- ( Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Baisi P.S.Case No. 19/2014, subject to the conditions as laid down under Section 438
(2) of the Cr. P.C.
