JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and one co-accused were caught by the informant and villagers just after the alleged occurrence and stolen bag containing cash was recovered from the dickey of the motorcycle of the petitioner.

The contention on behalf of the petitioner is that while petitioner along with co-accused was coming on the motorcycle, an accident took place which led to altercation and after that informant and his supporters badly assaulted by the petitioner and co-accused and after that handed over to the police with fabricated story. It is further contended by him that petitioner is in jail custody since 27.4.2015 and he does not have any criminal

The report of the trial court shows that up till now even charge could not be framed against the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Vaishali at Hajipur in connection with Lalganj P.S.Case No. 100 of 2015.
