KUMAR ORAL ORDER (The proceedings of the Court are being conducted through Video Conferencing and the Advocates joined the proceedings through Video Conferencing from their residence.) 15-09-2021 Heard learned counsel for the petitioners and the State.
This application has been filed by the petitioners for modification of order dated 29.11.2019 passed in Cr. Misc. No. 59462 of 2019, whereby petitioners were allowed anticipatory bail. One of the conditions therein was that they should surrender within four weeks from the date of the order and they will also refund Rs.25,000/- to the informant. However, it is submitted that the petitioners could not surrender within the aforesaid period as informant refused to receive Rs.25,000/- and, thus, petitioners seek extension of the
Patna High Court CR. MISC. No.6514 of 2020(5) dt.15-09-2021 2/2 time for surrender.
By order dated, 14.07.2020, petitioners were directed to hand over the draft of Rs.25,000/- to the learned counsel representing the informant.
It is submitted by learned counsel for the petitioners that a draft of Rs.25,000/- has already been handed over to informant which is accepted by counsel for the informant. In the facts and circumstances of the case, this application is allowed.
Let the period of surrender as per order dated 29.11.2019 passed in Cr. Misc. No. 59462 of 2019 be extended by further four weeks from the date of this order. (S. Kumar, J) Sanjay/- U T
