JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 04-03-2025 Heard Mr. Rajesh Kumar, learned counsel for the petitioner, learned counsel for the opposite party no. 2 and Mr. Dilip Kumar No. 1, learned Additional Public Prosecutor for the State.

2. The petitioner seeks bail in a case registered for the offence punishable under Sections 420, 376, 504, 506/34 of the Indian Penal Code and Section 4 of the POCSO Act.

3. Petitioner is said to have forcibly established physical relation with the victim.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that there is compromise between the parties. This fact has not denied by learned counsel for the opposite

Patna High Court CR. MISC. No.7385 of 2025(3) dt.04-03-2025 2/2 party no. 2. He submits that the date of occurrence is 16.01.2023 but FIR has been lodged on 22.01.2023 after delay of five days. He further submits that petitioner has one criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since 09.12.2024.

5. Learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances of the case, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Chhauradano P.S. Case No. 190 of 2023.
