The petitioner has preferred this application for grant of regular bail in connection with a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016. As per allegations in the F.I.R., 150.750 liters of IMFL was recovered from the house of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his house. He is in custody since 20.9.2020 and has no criminal antecedent. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case

Patna High Court CR. MISC. No.17002 of 2021(2) dt.13-08-2021 2/2 together with the petitioner not having any criminal antecedent and having remained in custody for over 10 months, the Court directs the petitioner to be enlarged on bail in connection with Dalsingsarai P.S. Case No. 277 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Samastipur.
