Learned counsel appearing for the petitioner placing reliance on Annexure-10 submits that the case of the petitioner is squarely covered by the decision of this Court in C.W.J.C. No. 18985 of 2017 dated 16.02.2018.

Learned counsel for the University does not dispute the aforesaid submission.

In view of the above and considering the submission of the learned counsel for the petitioner that the case of the petitioner

Patna High Court CWJC No.5147 of 2018 dt.30-03-2018 2/2 is covered by the decision of this Court dated 19.07.2011 passed in C.W.J.C. No. 8532 of 2008, the writ application is disposed of with a direction to the University to examine the case of the petitioner and if it is found that the case of the petitioner is covered by the decision of this Court, as contained in Annexure-10, similar treatment should be given to this petitioner also.

In the event the University finds that the case of the petitioner is distinguishable on facts and law, the University will pass reasoned and speaking order within a maximum period of three months from the date of receipt/production of a copy of this order. With the aforesaid, the writ application stands disposed of.
