The writ application has been filed seeking a direction upon the Respondent No.3 (the Municipal Commissioner, Patna Municipal Corporation) to dispose of the complaint of the petitioner dated 08.03.2017, whereby the petitioner had brought to the notice of the Respondent No.3 that one Devendra Prasad Singh @ Devendra Prasad

Patna High Court CWJC No.13009 of 2017(2) dt.18-03-2023 2/3 has constructed his multi-storeyed apartment in breach of the provisions of Bihar Municipal Act, 2007 and Bihar Building Bye-Laws, 2014 at Jagdeo Path, Patna. The learned counsel for the petitioner submits that the complaint filed by him was received in the office of the Patna Municipal Corporation on 02.03.2017 by one Satish and thereafter, on his complaint, a complain number was provided i.e. 3074/C on 08.03.2017, but till date, the complaint of the petitioner is pending.

The learned counsel for the petitioner thus submits that in the event, if a direction is issued upon the Respondent No.3 to dispose of his complaint that would satisfy the petitioner.

The learned counsel appearing for the Patna Municipal Corporation agrees to the submission made by the learned counsel for the petitioner.

Accordingly, the writ application is disposed of with a direction to the Respondent No.3 to dispose of the complaint Case No.3074/C dated 08.03.2017 of the petitioner within a period of two months from the date of
