Heard learned counsel for the petitioners.
The petitioners apprehend their arrest in connection with Daudnagar P.S. Case No. 197 of 2020, registered for the
Patna High Court CR. MISC. No.16545 of 2021(2) dt.18-01-2022 2/3 offences punishable under Sections 147, 148, 149, 341, 323, 307, 337, 338, 153, 353, 332, 283, 269, 270, 188 and 504 of the Indian Penal Code and 3 of Epidemic Act, 1897. As per allegation, the villagers blocked the road by placing two dead bodies on the road and demanded compensation in respect of deceased persons, who lost their lives in an accident. It is further alleged that the mob became furious and started abusing the police party and also thrown brickbats on the police personnel.
Learned counsel for the petitioners has submitted that the allegation are general and omnibus in nature and the petitioners have no criminal antecedent. The mob was demanding compensation regarding two deceased persons, who lost their lives in a road accident. He has also submitted that considering the facts and circumstances, three co-accused persons have been granted anticipatory bail by this court vide order dated 11.01.2022 in Cr. Misc. No. 14113 of 2021. Considering the above-mentioned facts and circumstances, let the petitioners be released on anticipatory bail in the event of their arrest or surrender within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each
Patna High Court CR. MISC. No.16545 of 2021(2) dt.18-01-2022 3/3 to the satisfaction of learned S.D.J.M., Daudnagar in connection with Daudnagar P.S. Case No. 197 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
