The petitioner seeks bail in Gopalpur P.S. Case No. 191 of 2020, registered for the offence punishable under Sections 302/34 of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, FIR named accused persons committed murder of brother of informant. It is submitted on behalf of the petitioner that petitioner is neither named in the FIR nor any incriminating article has been recovered from his possession. Name of petitioner surfaced in this case on the basis of confessional statement of co-accused Sunil Kumar and Pawan Kumar. Petitioner is in custody since 26.01.2021.

Patna High Court CR. MISC. No.6156 of 2022(3) dt.17-05-2022 2/2 Learned APP however, vehemently opposed the prayer for bail and submitted that during course of investigation ample evidence has come against this petitioner which show his involvement in this alleged occurrence and petitioner has criminal antecedent of 19 cases.

Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
