2. The petitioners have preferred this application for grant of regular bail in connection with Dagarua P.S. Case No. 282 of 2024 dated 10.09.2024 registered for the offences punishable under Section 309(4) of the Bhartiya Nyay Sanhita.

3. As per the prosecution case, the informant kept Rs. 1,06,053/- in the power box of motorcycle and was going to deposit in the nearest CSP. As the informant stopped at Sindhiya Bridge and shared information through Whatsapp group about the above money, in the meantime, three unknown persons riding on motorcycle came and took the money by breaking the

Patna High Court CR. MISC. No.5575 of 2025(2) dt.04-03-2025 2/3 power box of the motorcycle. Also took out Rs. 3000/- from the back pocket of the informant's pant and a mobile phone. The motorcycle of the accused persons did not have number plate.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The petitioner is not named in the FIR. The name of the petitioner has been transpired in this case in the confessional statement of co-accused, Akhilesh Kumar Yadav. Nothing has been recovered from the conscious possession of the petitioners. The petitioner has no concern with the alleged offence. The petitioners have two antecedents as stated in para 3 of the bail petition. The petitioners are in custody since 30.10.2024.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioners and submitted that Rs. 10,000/-, a mobile phone and motorcycle was recovered from the house of the petitioner no.1 and from the possession of the petitioner no.2 Rs. 16,000/- and a mobile phone was recovered.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with
