The petitioner seeks bail in Samastipur Rail P.S. Case No.204 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act. Allegation against the petitioner is recovery of liquor, while the petitioner was carrying a sky coloured plastic bag on his head.

Submission of learned counsel for the petitioner is that the petitioner has been falsely implicated in this case having no criminal antecedent and he in custody since 07.12.2019. The petitioner is ready to co-operate in the investigation. Heard learned Addl. Public Prosecutor.

Considering nature of allegation, let the petitioner,

Patna High Court CR. MISC. No.4869 of 2020(2) dt.29-01-2020 2/2 above named, be enlarged on bail on furnishing bail bond of Rs.25,000/-(twenty five thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. Sessions Judge-cum- Special Judge, Excise Act, Samastipur in connection with Samastipur Rail P.S. Case No.204 of 2019 with condition that the petitioner shall co-operate with the trial/investigation, failing which the court below shall be at liberty to cancel bail bond of the petitioner.
