JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date : 09-07-2019 This application under Articles 226 and 227 of the Constitution of India has been filed by the petitioner for directing the trial court to conclude Session Trial No. 757 of 2012, arising out of Hathauri P. S. Case No.14 of 2012 registered inter alia under Section 302 of the Indian Penal Code.

By order dated 14.05.2019, a report was called for from the 5th Additional Session Judge, Muzaffarpur as to why the trial has not been concluded in spite of the fact that the prosecution evidence was closed on 02.05.2017. 3.

A report dated 20.05.2019 has been received from the court of 5th Additional Sessions Judge, Muzaffarpur stating therein that the defence evidence has been closed on 16.05.2019 and the case has been fixed for final argument on 23.05.2019. It has also been stated in the report that no further delay is expected in the matter.

However, it has been brought to the notice of the court that after the report was sent to this court, aforesaid session trial has been transferred to the court of 4th Additional Sessions Judge, Muzaffarpur from the court of 5th Additional Sessions Judge, Muzaffarpur.

Be that as it may, since the evidences on behalf of the parties have been closed and the case has been fixed for final arguments, there is no reason for any further delay in the matter.

Considering the facts and circumstances of the case, the trial court (4th Additional Sessions Judge, Muzaffarpur) is directed to fix the case for arguments within one week from the

Patna High Court CR. WJC No.944 of 2018 dt.09-07-2019 3/3 date of receipt/production of a copy of the order. The arguments shall be held on day-to-day basis. After the hearing is concluded, the judgment in the case must be passed within two weeks. 7.

It is made clear that no adjournment on any ground shall be granted to either of the parties. Once the judgment is delivered the trial court shall send a report to this court. 8.

With the aforesaid directions, the application is disposed of.
