The petitioner apprehends his arrest in Amarpur P.S. Case No. 413 of 2019, registered for the offence punishable under Sections 379/411 of the Indian Penal Code, sections 4/40 BMMC Rules and Sections 3,6, and 8 BMMC Rules 2003. Petitioner is alleged to have stored 900 CFT of illegal sand.

It is submitted that petitioner has falsely been implicated in this case. Petitioner is farmer. Recovery is made from the bank of river. Petitioner has got no concern with the recovered illegal sand. Petitioner has got clean antecedent. Considering the facts aforesaid, the petitioner

Patna High Court CR. MISC. No.4344 of 2020(2) dt.05-03-2020 2/2 above-named in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No.413 of 2019 subject to the condition that petitioner will deposit Rs. 6,000/- in the court below, within a period of two weeks from today, subject to the outcome of case.
