The petitioner is apprehending his arrest in a case registered under Sections 420, 406, 506, 34 of the Indian Penal Code and 3⁄4 of D.P. Act.
Prosecution case is that the marriage of informant's daughter was settled with the petitioner and thereafter, more demand was made from the informant for solemnization of marriage and ultimately, marriage could not be performed. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been falsely implicated in the present case. Counsel for the petitioner has produced a demand draft No.
Patna High Court CR. MISC. No.6548 of 2019(4) dt.06-03-2019 2/2 028784 for Rs. 5,00,000/- (five lacs) issued on 08-02-2019 in favour of the informant, Gopal Sah by Bank of Baroda, Bhojpur (Ara) branch. Counsel for the informant accepts the said draft prepared in his favour.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Arrah in connection with Mahila P.S. Case No. 124 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
