2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections-498A, 494, 341, 342, 323, 307, 504, 506/34 of the Indian Penal Code.

3. As per allegation, the marriage of the petitioner was solemnized with the informant on 07-05-2015. After marriage, the accused persons demanded dowry in cash and a four wheeler and inflicted atrocities on the informant.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated

Patna High Court CR. MISC. No.10054 of 2024(4) dt.12-07-2024 2/3 in this case. As a matter of fact, the petitioner has already filed a case for divorce on the ground of adultery and thereafter, the informant has filed the present case. He has also submitted that the matter was referred to Patna High Court Mediation and Conciliation Centre and it was agreed between the parties that the petitioner shall pay Rs. 12500/- per month to the informant as interim maintenance subject to the final outcome of the maintenance case, which has been filed by the informant. Learned counsel has also submitted that as per orders given by this Court, the petitioner is paying Rs. 12500/- to the informant per month.

5. Learned counsel for the opposite party has opposed the prayer for bail and submitted that the amount of maintenance is too meagre to meet the daily expenses of the informant and her children.

6. Considering the aforesaid facts and circumstances, let the petitioner named above, in the event of arrest or surrender in the court below within a period of six weeks be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Jamui in connection with Chakai P.S. Case No. 178 of 2023

Patna High Court CR. MISC. No.10054 of 2024(4) dt.12-07-2024 3/3 with conditions as laid down under Section-438(2) of the Cr.P.C.

7. The petitioner is directed to pay Rs. 12500/- per month to the victim till disposal of the Maintenance Case. This order shall be subject to final outcome of the Maintenance Case. (Nawneet Kumar Pandey, J) A.K.V.//- U T
