JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-08-2023 This is second application filed on behalf of petitioner for modification of the order dated 26.03.2021, passed in Cr. Misc. No. 34604 of 2020 whereby petitioner was directed to surrender before the court below within a period of four weeks from the date of order, but due to unavoidable circumstances, the petitioner could not surrender in the court below and furnish the bail bond within the stipulated time.

2. It is submitted that earlier vide order dated 15.09.2021 passed in Cr. Misc. No. 49025 of 2021, four weeks further time from the date of order, was granted to the petitioner to surrender in the court below, but this time also petitioner could not surrender, therefore, seeks further two weeks time to surrender in the court below.

3. For the reasons assigned in para 3 of the application, four weeks further time from the date of receipt of this order is allowed to the petitioner to surrender in the court below, subject to deposit of Rs. 10,000/- to the District Legal Services Authority. At the time of surrender, the petitioner shall furnish the receipt showing deposit of Rs. 10,000/- to the District Legal Services Authority.

4. This modification application is accordingly, allowed.
