Victim in her statement recorded under section 164 of the Cr.P.C, specifically, stated that she was kidnapped by mother of the petitioner and thereafter, she was forcibly taken to Bangalore by this petitioner where she was confined in a room and the petitioner committed rape on her but submission on behalf of the petitioner is that alleged occurrence took place on 5.4.2013 whereas first information report was lodged on 2.5.2013 and moreover there was love affair between the petitioner and the victim who herself eloped with the petitioner and later on, she, in collusion with her parents, took 'U' turn when her statement under section 164 of the Cr.P.C was recorded.
