The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 399 and other ancillary sections of the Indian Penal Code and sections 25(1-B)a, 26 and 35 of the Arms Act and section 8 and other sections of the NDPS Act.
As per the prosecution case, one motorcycle and one mobile phone have been recovered from the possession of the petitioner.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He submits that no arms and ammunition and the narcotic
Patna High Court CR. MISC. No.6983 of 2022(2) dt.07-04-2022 2/2 substance have been recovered from the possession of the petitioner. Petitioner has claimed clean antecedent and he is in custody since 26.11.2021.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge cum Special Judge Motihari, East Champaran in Ghorasahan Police Station Case No. 501/2021, NDPS Case No. 113 of 2021.
