NILU AGRAWAL ORAL ORDER 08-02-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. Petitioner is languishing in judicial custody since 28.10.2018 in connection with G.R.P. Patna Junction P.S. Case No. 379 of 2018 for offences punishable under Sections 379, 411 of the Indian Penal Code.

The prosecution case as lodged by the informant is that on 27.10.2018 at 7 PM while he along with his family members were coming out from the ticket counter of Patna Junction, petitioner snatched away the golden chain of his son. It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal antecedent and has been falsely implicated in the aforesaid case. He further submits that no incriminating article has been recovered from the conscious possession of the petitioner. He further submits

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances of the case and nature of allegation, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Railway, Patna in connection with G.R.P. Patna Junction P. S. Case No. 379 of 2018, subject to the condition:

(1) One of the bailors would be close relative of the petitioner having sufficient immovable properties, who will file an affidavit stating his relationship with the petitioner. devendra/- (Nilu Agrawal, J) U
