====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 16-09-2025 Heard learned counsel for the petitioner as well as learned APP for the State and the learned counsel for the informant.

2. The petitioner apprehends his arrest in connection with Alamganj P.S. Case No. 940 of 2023, registered for the offences punishable under Sections 498(A), 494/34 of IPC.

3. It is a case of matrimonial dispute. As per FIR, the petitioner, who is husband of the victim, tortured her for nonfulfillment of demand of dowry. It is further alleged that the petitioner has solemnized his second marriage.

4. The learned counsel for the petitioner has submitted

The petitioner has filed divorce case bearing Matriomonial Case No. 525 of 2015 which is pending before the court of Additional Principal Judge, Patna and thereafter, this case has been lodged under Section 498(A) of the IPC. He has submitted further that a number of cases has been lodged against the petitioner, either by the informant or her family members. He has also submitted that the petitioner is ready to pay Rs. 5,000/- per month as interim maintenance to the informant.

5. On the other hand, the learned APP for the State and the learned counsel for the informant have opposed the prayer for bail by submitting that the informant is passing miserable days in financial scarcity in her paternal house.

Considering the above-mentioned facts and circumstances, especially the fact that the petitioner is ready to pay Rs. 5,000/- per month as interim maintenance to the informant, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Patna City in connection with Alamganj P.S.

7. The petitioner is directed to pay Rs. 5,000/- per month as interim maintenance to the informant. The amount of maintenance passed by any other forum shall be adjusted in that amount.
