The petitioner is languishing in custody for the offences punishable under Section 364A of the Indian Penal Code. Later on offence under Section 302 of the Indian Penal Code was added.

According to FIR, the son of the informant was found missing in the evening. Ransom was demanded from the informant on mobile call from mobile No.7250368762. The said mobile was of one Phulmati. From mobile of Phulmati call was made on the mobile phone of the petitioner also. Hence, the police arrested the petitioner as well as his father. Thereafter, on the disclosure of the petitioner dead-body of the son of the

Patna High Court CR. MISC. No.6595 of 2019(4) dt.23-04-2019 2/2 informant was recovered from the room of this petitioner. Hence, strong suspicion was there that the petitioner has committed the murder.

Petitioner is in custody since 27.12.2016 and the trial has recently been committed to the Court of Sessions. The petitioner has got no criminal antecedent.

Considering the nature of material and the period already undergone and chances of non-conclusion of trial in near future, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Ramgarh P.S. Case No.272 of 2016, with condition that petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
