Mr. Ajit Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-01-2020 Petitioner seeks bail in connection with Baikunthpur P.S. Case No. 290 of 2018 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

Prosecution case is of recovery of 300 litres of liquor from Bolero vehicle and one person was arrested, who disclosed the name of the petitioner and other accused persons and petitioner is accused in five other cases, out of which three are of similar nature.

Submission of learned counsel for the petitioner is that he has falsely been implicated and he is not named in the FIR and on the basis of confessional statement of co-accused he has been made accused and he is in custody for more than one month.

Patna High Court CR. MISC. No.4935 of 2020(2) dt.29-01-2020 2/2 Heard learned APP, who has opposed the prayer for bail of the petitioner stating that petitioner has criminal antecedents.

In view of above facts and circumstances, at this stage I am not inclined to grant bail to the petitioner. However, once charge has been framed in this case, petitioner is at liberty to renew his prayer for bail.

This application is, accordingly, dismissed.
