JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 2.6.2014 in a case registered for the offences punishable under Sections 436 and 427/34 of the Indian Penal Code.

It is alleged that in absence of the informant co accused Manjum Khatoon, Md. Kamil and the petitioner set fire to three houses of the informant.

It is submitted by the learned counsel for the petitioner that in the subsequent statement informant stated that fire was lit only in the cattle shed and not in the dwelling house whereas wife of the informant alleged accusation only against Manjum Khatoon. Wife of the petitioner filed a case in which the informant has been chargesheeted under sections 341,323,324,325,379,447

Patna High Court Cr.Misc. No.36994 of 2014 (3) dt.16-01-2015 2/2 and 504/34 IPC, hence, as a retaliatory measure the present case has been lodged. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Forbesganj P.S. Case No. 175 of 2014.
