The petitioner seeks bail in a case registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act. The informant named 20 persons including the petitioner and alleged that they all made indiscriminate firing while the informant and his brother were ploughing their land. The informant and his brother fled away, but at the instigation of Md. Khalik, Md. Barik and Md. Rakib, Md. Naushad fired which hit on the wrist of his brother.
It is submitted that Md. Naushad and Md. Aurangjeb @ Tarjan made firing and the shot of Md. Aurangjeb @ Tarjan hit on the wrist of his brother and the shot fired by Md. Naushad hit on
Patna High Court Cr.Misc. No.35831 of 2015 (2) dt.21-08-2015 2/2 the mouth of his brother. His brother fell down on the ground. No specific allegation of firing is made against the petitioner. Similarly situated other accused persons have already been enlarged on bail.
Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in Mufassil P.S.
