Patna High Court CWJC No.18619 of 2016 dt.11-04-2018 2/3 T.B. patients in various centres and hospital is being adversely affected and, therefore, seeking a mandamus for making arrangement for providing alcohol for treatment of T.B. patients in various hospitals and T.B. Centres, this petition has been filed.

A counter affidavit has been filed by the competent authority of the State Government i.e. the Deputy Commissioner, Excise, Headquarter, Patna Sri Om Prakash Mandal and the department has brought on record two notifications and orders issued vide Annexures A and B indicating exemption granted and the procedure to be followed for supply of alcohol for treatment of T.B. patients and various provisions have been laid down in these orders with regard to the manner in which the supply is to be made. It is pointed out in the counter affidavit that as and when requisites are received for supply of alcohol to the centres, orders akin to Annexure- A and B are being passed granting the said permission. Keeping in view the aforesaid, for the present now no further indulgence into the matter in this Public Interest Litigation is called for. The supply in accordance to the order shall be maintained by the Government so that treatment of the T.B. patients are not adversely affected.
