JUSTICE ARVIND SRIVASTAVA ORAL ORDER 03-01-2022 At the outset, learned counsel for the petitioner seeks permission to withdraw this application as against petitioner no. 2 as he has been arrested during pendency of this application.
Permission is granted.
The application, thus, stands dismissed as withdrawn as against petitioner no. 2.
Heard learned counsels for the petitioner and the State.
Petitioner apprehends arrest in connection with Bhagwanpur Hat P.S. Case No. 17 of 2019 registered for the offence punishable under sections 341, 323, 307/34 of
Patna High Court CR. MISC. No.16778 of 2021(2) dt.03-01-2022 2/2 the Indian Penal Code.
Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Similarly situated co-accused persons have been granted bail by a co-ordinate Bench of this court vide order dated 21.01.2020 passed in Cr. Misc. No. 3459 of 2020. Petitioner has no criminal antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner no. 1, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing personal bond to the satisfaction of Additional Chief Judicial Magistrate, II, Siwan in connection with Bhagwanpur Hat P.S. Case No. 17 of 2019 subject to the conditions laid down under section 438(2) Cr.P.C.
