====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-07-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in case registered for the offences punishable under Sections 420, 409, 120(B)/34 of the Indian Penal Code.

As per prosecution case, all the F.I.R. named accused persons including this petitioner looted cash of Rs. 2.40 crore from the cash van which was supposed to be loaded in the S.B.I. ATM.

Learned counsel for the petitioner submits that name of the petitioner transpired on the basis of confessional statement of co-accused. No incriminating material has been recovered from the conscious possession of the petitioner and he has got clean antecedent.

Patna High Court CR. MISC. No.7895 of 2023(4) dt.11-07-2023 2/2 Learned A.P.P. for the State opposes the prayer for bail application and submits that huge amount has been looted in the alleged occurrence and anticipatory bail of similarly situated co-accused, namely, Sarfaraj @ Sonu @ Sanfaraj, has already been rejected by co-ordinate Bench of this Hon'ble Court vide order dated 08.05.2023 passed in Cr. Misc. No. 6819 of 2023.

Considering the aforesaid facts, prayer for anticipatory bail of the petitioner is refused. (Prabhat Kumar Singh, J) Navya/- U T
